Waiver of Liability and Policy Agreement

 

By completing this online waiver, and in consideration of and as an inducement to my registration and payment of fees to become a participant of a retreat with Firefly Community LLC (hereinafter “Firefly”), I represent and agree as follows:

I acknowledge that trips conducted by Firefly have risks inherent in them. I recognize the trip activities can result in serious injury to my property and myself, including death. I realize surface conditions during the trips will vary; obstacles and hills exist on some paths, trails, and roads; and I will be in proximity to vehicles, bicyclists, pedestrians and other hazards, all of which can be dangerous. Furthermore, I understand I am responsible for my own safety when drinking or tasting wine, beer, or other alcohol on any of Firefly's trips and always have the option to not consume alcohol.

 

I confirm that I have been examined by a licensed Physician within the past six months and have been found by such physician to be in good health and fully able to perform all yoga exercises, which I am to learn and perform during the retreat. I will faithfully follow all instructions given to me by Firefly authorized instructors as to when and how to perform and not to perform yoga exercises. I understand the practice of yoga and group exercise activities may expose me to risk of personal injury, disease, or death and I knowingly and willingly assume such risk.​In the event that I am pregnant, I will not attend a yoga class until I have discussed the potential risks to me or my unborn child/fetus with my obstetrician. I agree that I will follow my obstetrician’s recommendations and on behalf of myself, my heirs, spouse or other interested party hold harmless Firefly for any possible injury to myself or my unborn child/fetus.

I acknowledge that registration payments and deposits paid hereafter are non refundable. I understand that if I choose not to contract for travel insurance I am accepting the risks of my having to cancel my trip due to injury, illness, a change in my plans, or any other reason and will readily abide by Firefly's cancellation policy. I acknowledge that if I need to cancel less than 60 days prior to the retreat, for whatever reason, I will not receive a refund or credit. No refund or credit will be given for arriving late or departing early. I agree that in order to hold my space, payments must be made in accordance with the payment schedule.

In partial exchange for the tour, I give Firefly permission to use photos or other images taken by me which I make available to Firefly, or images taken of me during the tour for any purpose, including but not limited to use in brochures, websites, marketing, and publicity. I furthermore agree to wear appropriate safety gear (as applicable) and to obey all local regulations.

I acknowledge the contagious nature of the Coronavirus/COVID-19 and further acknowledge that Firefly has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.

I further acknowledge that Firefly cannot guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Firefly staff, and other clients and their families.

I voluntarily seek services provided by Firefly and acknowledge that I am increasing my risk of exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending a Firefly event.

 

Any provision not in conformity with the law of any state or governing body having jurisdiction is hereby severed from this contract and the remaining provisions remain enforceable. I agree that any dispute regarding this Agreement will first be tendered by the parties to a member of The American Arbitration Association for resolution prior to the filing of any lawsuit. Therefore, I hereby agree not to sue Firefly or any of its owners, employees, or contractors. I also release these parties from all liability to myself, my representatives, heirs, and next of kin for any and all damages to myself or my property, death, and related claims. 

 

I understand that by submitting this Registration Form I am releasing my rights; acknowledging that retreats operated by Firefly are inherently risky; and accepting the validity of this online waiver.
